What personal data is collected, what it is used for and the lawfulness of its processing

Visit the website

When you visit the Site, we automatically collect information about you and your use of the Site, such as the type of browser you use, the search terms you use on the Site, your IP address, including your network location, and information about your computer.

The purpose is to optimize the user experience and functionality of the Site and to conduct targeted marketing, including retargeting via Facebook, Instagram and Google. This data processing is necessary to protect our interests in improving the website and providing you with relevant offers.

Booking a Holiday Home

When you rent a holiday home or communicate with us on the website, we collect the information you provide, such as your name, address, e-mail address, telephone number, payment method, information about the holiday home you wish to rent and the period, special requests, and information about the IP address from which the order is made. In addition, your name and nationality will be visible to the owner of the holiday home.

The purpose is to enable us to process and communicate your vacation rental reservation and otherwise fulfill our contract with you, including the administration of your cancellation and complaint rights. We also process information about your use of a vacation home to comply with legal requirements, including for bookkeeping and accounting purposes. We collect the IP address to protect our interest in preventing fraud. In addition, in certain cases, we may use your contact information to send you notices related to your vacation rental reservation, e.g., through a third-party vendor. The lawfulness of the processing is based on Art. 6, par. 1 b, c and f of the EU General Data Protection Regulation.

When you sign up for our newsletter or last-minute email service, we collect information about your email address. We also process the information you provide us about your preferences and interests. There are a number of cookies associated with our newsletter that allow us to analyze which newsletters are read, etc. See below for more information.

Questionnaire

When you complete our questionnaire after your stay with us, we collect and process the information you provide about your preferences and interests, the cottage, the area and Esmark. You decide whether your information can be published or to what extent published statements must remain anonymous.

The purpose is to protect our interests, to continually improve our service, to provide future guests with honest information about individual properties, resorts and Esmark, and to send you targeted newsletters that are as relevant to you as possible.

Chat

When you use our chat feature on the Site, we collect and process the information you provide to us about your preferences and interests. We collect your IP address, including your network location, and information about your computer to protect our interest in preventing fraud and to be able to recognize your chat profile the next time you use the chat feature on your own computer.

The purpose of the subsequent storage of the data is to be able to continuously evaluate and optimize the service provided to you.

Technical functionality so that we can remember your preferences, such as whether or not you have accepted cookies.
Traffic measurement and visit statistics, which we use primarily to improve the content and navigation of the site. We use both our own cookies and Google Analytics. Anonymous information is collected, such as how long you have been on the site, what pages you have viewed, whether your computer has been tracked before, what browser and operating system you are using, etc.

Recipients of personal data

Renters

Your name, address, email address, phone number and rental period will be sent to the vacation rental owner.

General Information

Information may be shared with external business partners who process the information on our behalf. Among other things, we use third parties for the technical operation and improvement of the website, to send newsletters and last-minute emails, for targeted marketing, including retargeting, and for your evaluation of our company and products.

These companies are processors, subject to our instructions, and process information that we are responsible for protecting. Processors may not use the information for any purpose other than to fulfill their contract with us and must keep the information confidential.

We have entered into written processor agreements with all of the processors that process personal data on our behalf. Four of these processors, Google Analytics c/o Google LLC, Facebook Inc, Mailchimp c/o the Rocket Science Group LLC d/b/a Mailchimp and LiveChat Inc, are located in the United States. The necessary guarantees for the transfer of data to the USA are provided by the certification of the processors in accordance with the EU-U.S. Privacy Shield, see Art. 45 of the EU General Data Protection Regulation.

In order to create openness regarding the processing of your data, we must inform you, as the data controller, of your rights.

Right of access

You have the right at any time to ask us for information about the data we have collected about you, the purpose of the collection, the categories of personal data and any recipients of the data, as well as the origin of the data. You have the right to obtain a copy of the personal information we hold about you. If you would like a copy of your personal data, please send a written request to to [email protected]. You may be asked to prove that you are the person you say you are.

Right to Correction

You have the right to have any inaccurate personal information about you corrected by us. If you discover that the information we hold about you is incorrect, please contact us in writing to have the information corrected.

Right to erasure

In some cases, you have the right to have all or some of your personal data deleted by us, for example, if you withdraw your consent and there is no other legal basis for the processing. To the extent that further processing of your data is necessary, for example to comply with our legal obligations or to establish, exercise or defend legal claims, we are not obliged to delete your personal data.

Right to restriction of processing

In some cases, you have the right to restrict the processing of your personal data so that it is only stored, e.g. if you believe that the information we process about you is incorrect.

Right to data portability

In some cases, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller.

Right of objection

You have the right to object at any time to our processing of your personal data for direct marketing purposes, including profiling for direct marketing purposes. You also have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data that we carry out on the basis of our legitimate interests.

Right to Withdraw Consent

You have the right to withdraw your consent to the processing of your personal data, including the creation of a profile of you as a recipient of our newsletter, at any time. If you no longer wish to receive our newsletter, you can unsubscribe at any time directly in any newsletter sent to you or by going to https://esmark.de/newsletter/. If you no longer wish to have a profile in our chat system, you can delete your profile by sending an email to [email protected].

Right to complain

You have the right at any time to lodge a complaint about our processing of your personal data with the Danish Data Protection Agency, Datatilsynet, Borgergade 28, 5, 1300 Copenhagen K. The complaint can be submitted by e-mail to [email protected] or by telephone on +45 33 19 32 00.

Deletion of personal data

The information collected about your use of the Site will be deleted at the latest when you have not used the Site for one year. Data collected in connection with your registration for our newsletter or last minute service will be deleted at the latest when you have not opened any newsletters or last minute e-mails for one year, unless we have another basis for processing the data. Information collected through the chat function will be deleted once a year, unless you have asked us to delete your profile earlier.

Information collected in connection with the rental of a vacation home is generally deleted five years after the end of the calendar year in which you last rented a vacation home. However, information may be kept longer if we have a legitimate need to keep it longer, such as to establish, exercise, or defend legal claims, or to comply with legal requirements. Accounting records are retained for five years after the end of a fiscal year to comply with the requirements of the Accounting Act.

Security

We have appropriate technical and organizational security measures in place to protect against the accidental or unlawful destruction, loss, alteration, or damage of personal data, and against unauthorized access or use. Only employees who have a legitimate need to know your personal information in order to perform their job will have access to it.
