Rental Conditions 2025

The rental agreement includes the holiday home with inventory and waste disposal. Energy consumption will be settled upon departure. The holiday home may only be occupied by the maximum number of people specified in the rental agreement. Pets may only be brought along if this has been agreed upon. For liability reasons, you may not transfer cleaning duties to any third parties. The setting up of tents and caravans on the property is not permitted. If these conditions are not complied with, Esmark is entitled to terminate the rental agreement immediately and without a refund of any payments made. Furthermore, the tenant is obliged to reimburse Esmark for any losses and additional costs incurred due to non-compliance.

Upon conclusion of the contract, Esmark sends the rental agreement to the tenant. The processing fee is €34 per rental agreement. The agreed rent must be paid either in full or in two instalments. If paid in two instalments, then as follows:

  • The first instalment is due 4 days after booking and amounts to 35% of the rent plus processing fee.
  • The second instalment is due no later than 50 days before arrival and amounts to the remaining 65% of the rent plus optional extra

If the contract is concluded less than 50 days before the start of the rental period, the total amount is due immediately. The payment terms and bank details for the transfer can be found in the rental agreement. Failure to meet the payment deadlines will be considered a cancellation by the tenant. In this case, Esmark reserves the right to cancel the rental agreement without notice in accordance with the cancellation fees mentioned in the rental terms.

Rebooking or transfer of the rental agreement to another tenant

A rebooking or transfer of the rental agreement is possible up to 60 days before the start of the rental period upon payment of a rebooking fee of €89. Rebooking of the travel period is only possible within the same calendar year. A later rebooking or transfer will be considered a cancellation, and the above-mentioned cancellation conditions apply.

Changes to the rental agreement

An extension of the rental period or a change in the number of travellers is possible free of charge. Other optional additional services such as final cleaning, linen packages, handcarts, etc. can be ordered before arrival or cancelled free of charge.

Cancellation

The tenant may cancel the rental agreement at any time in writing, either by e-mail to the address provided in the rental agreement or by post. The time of cancellation is deemed to be the time it is received by Esmark. Unless the cancellation is due to circumstances that fall under Esmark’s extended right of withdrawal, the following cancellation fees apply:

  • Cancellation up to and including 75 days before arrival – 25% of the rental amount, but at least €105.00
  • Cancellation 60–74 days before arrival – 50% of the rental amount
  • Cancellation 30–59 days before arrival – 75% of the rental amount
  • Cancellation 15–29 days before arrival – 90% of the rental amount
  • Cancellation less than 15 days before arrival – 100% of the rental amount

Processing and rebooking fees are non-refundable. Amounts for optional extras such as final cleaning, bed linen, handcarts, etc. will be refunded. For contracts resulting from a rebooking, the cancellation costs will be calculated based on the higher amount.

Extended right of withdrawal before arrival

The rental agreement can be cancelled without cancellation fees if the tenant’s stay in the rented holiday home becomes impossible or significantly more difficult due to:

  • Death of the travelling persons or their spouse, children, parents, siblings, grandparents, grandchildren, in-laws, or due to acute illness or serious injury requiring hospitalization, medically prescribed bed rest, or similar. Acute illness means a newly occurring illness, justified suspicion of a serious newly occurring illness, or an unexpected worsening of an existing or chronic illness.
  • Significant damage due to fire or burglary at the tenant’s private home/apartment within 2 weeks before the arrival date or due to fire, burglary, or contractual work interruption in the tenant’s own business.
  • Involuntary unemployment after the conclusion of the rental agreement.
  • A new job that prevents the tenant from taking the holiday at the booked time.
  • Pregnancy of a fellow traveller after conclusion of the rental agreement.


Conditions for free cancellation:

  • The tenant must inform Esmark in writing within 24 hours of the reason for cancellation and before the time of arrival stated in the rental agreement.
    Esmark must receive proof of the event entitling the cancellation within 3 days (72 hours) of notification, e.g., medical certificate, death certificate, police report, dismissal notice, or new employment contract. The costs of providing proof must be held by the tenant.
  • The tenant may cancel the rental agreement from the time of booking up to the time of arrival stated in the agreement.

If the tenant cancels under the above conditions, the full rental amount will be refunded minus the processing fee paid.

Other costs associated with the cancellation are not relevant to Esmark. Tenants are advised to contact their insurance provider. For questions regarding cancellation, please contact Esmark.

The tenant’s right to cancel does not apply if:

  • Fellow travellers wish to use the stay.
  • The reason for cancellation was known or foreseeable when the booking was made.
  • Compensation for rental costs can be claimed from another party under travel conditions, legal provisions, conventions, or travel guarantees.
  • Compensation has been paid out by an insurance company.
  • The reason for cancellation is a pre-existing illness with symptoms or treatment occurring within two (2) months before the agreement.
  • A doctor had advised against travel at the time of booking.
  • Cancellation is due to failure to meet travel requirements such as passports, visas, vaccinations, etc.
  • Cancellation is due to a pandemic.

Extended right of withdrawal during the stay

The rental agreement may be cancelled during the stay with immediate effect and without cancellation fees (except for the processing fee), and with a partial refund of the rental amount, if the tenant cancels due to:

  • Death of a fellow traveller or their relatives, or due to acute illness or serious injury requiring hospitalization, bed rest, or similar.
  • Significant damage from fire or burglary at the tenant’s home or own business during the stay.

Conditions for free immediate cancellation during stay:

  • The tenant must inform Esmark in writing within 24 hours of the event.
  • Proof of the event must be provided to Esmark within 3 days (72 hours). The cost of documentation is held by the tenant.


The tenant may then cancel for the remaining full days of the rental period. The refund is calculated from the date of cancellation to the departure date, based on full unused days, excluding the processing fee. If interruption occurs after 10:00 AM, reimbursement starts the next day. The tenant and all travellers must vacate the house.

The tenant's right to cancel during stay does not apply if:

  • The tenant reuses the booking.
  • The event occurred or was foreseeable before the stay.
  • Fellow travellers continue the stay.
  • The cancellation is due to a pandemic.

Free holiday home insurance in cooperation with Max Levig/Tryg

The holiday home insurance in Esmark Travel Security covers the tenant’s liability for damage caused to the contents of the rented holiday home during the rental period, up to DKK 8,000. This includes damage to windows, sinks, kitchen worktops.

The insurance does not cover:

  • Normal wear and tear, scratches, stains, etc.
  • Theft by tenant or guests.
  • Damage caused intentionally.
  • Damage caused under self-inflicted influence of alcohol or drugs if it significantly contributed to the incident.
  • Damage from pets.
  • Damage to bikes and watercrafts including parts.
  • Damage from motor vehicles, caravans, trailers, planes.
  • Cosmetic damage to sinks, spa facilities.
  • Damage to sauna or infrared sauna.
  • Damage to swimming pools, hot tubs, and their water.
  • Fire damage to kitchen counters.
  • Items brought by the tenant.


The insurance covers up to DKK 75,000 for interior damages.

Compensation calculation:

  • Items under 2 years and undamaged before the incident will be replaced at new cost.
  • Items over 2 years: compensation is based on replacement value minus 10% per year from purchase date, with a minimum of 20% of new value.
  • Esmark may choose to repair or pay current value.
  • Esmark may, but is not obligated to, provide replacement in kind.


Claim recognition

Max Levig/Tryg only covers costs they have approved. Payment or recognition by the tenant does not bind Max Levig/Tryg. Premature liability acknowledgement may leave the tenant liable.

In case of damage

The tenant must inform Esmark immediately and provide documentation. For inventory damage, the tenant must acknowledge the damage.

Double insurance

This insurance does not cover costs already covered by other insurance.

Recourse

If a property insurance covers the damage, liability insurance does not apply unless the damage was intentional or grossly negligent.

Complaints must be filed using a specific form and accompanied by a fee.

Legal proceedings remain possible. Legal aid may be available depending on income.

100% price guarantee

Applies if the booked holiday home is available for a lower price under the same conditions and currency through another online portal. In such cases, the price difference will be refunded.

Not applicable for price differences due to tax increases or exchange rate fluctuations.

Tenant’s responsibility

The tenant must treat the holiday home with care and leave it clean and tidy. If pets are brought, hair must be removed—even if final cleaning was booked or included.

Damage must be reported immediately to Esmark.

Esmark and the homeowner are not liable for the tenant or their property. The tenant is responsible for their insurance.

Forgotten Items

Forgotten items found in the house will be kept for up to two weeks. If no one claims them during this period, the items will be disposed of or donated to a charitable organization. To have a forgotten item returned, a fee of €30 will be charged for search and administration, plus postage costs. Esmark assumes no liability for the return of forgotten items.

Utility Costs

Unless otherwise stated, utility costs (e.g., electricity, heating, solar, oil, water) are not included in the rent and must be paid upon return of keys.

Deposit

Generally, no deposit is required. Esmark reserves the right to demand one in special cases:

  • Youth groups under 25 years: €700 per person
  • At the homeowner’s request
  • If Esmark deems it necessary


Deposits are refunded within 14 days after departure if the house was properly left and all costs paid. Utilities are paid separately and not deducted from the deposit.

Complaints

Unexpected complaints must be reported to Esmark immediately. Esmark may resolve the issue on behalf of the homeowner. If a justified complaint is not resolved within 24 hours, a discount is granted based on Danish holiday home association rates.

Pets must not be left alone in the house if a service visit is required.

Complaints about cleaning must be reported upon arrival and before moving in. After-hours arrivals waive the right to complain about cleaning. Complaints upon or after departure are not accepted.

Taxes and fees

Esmark may increase rent accordingly if taxes or fees rise, with documentation.

Force Majeure and extraordinary events

If the holiday home cannot be made available without significant cost or difficulty due to force majeure, which was unforeseeable for Esmark at the time of contract conclusion – including but not limited to war, strike, natural disasters, pandemic, epidemic, environmental pollution, or public restrictions – Esmark is entitled to terminate the rental agreement immediately, both in its own name and on behalf of the homeowner.

Esmark as Intermediary

Esmark is not the property owner but acts as an intermediary between tenant and owner. All information provided on the website is given to the best of its knowledge and belief.

Further Conditions

Esmark is not responsible for noise due to construction, traffic, military exercises, etc.

When renting a holiday home with a swimming pool or a standing water hot tub, the tenant agrees that the service technician may enter the holiday home once a week during regular working hours without prior notice and without the tenant being present, to ensure compliance with hygiene regulations and proper water quality.

Legal Disputes

Danish law applies exclusively. Jurisdiction is Herning.
