Rental Conditions 2026

The rental contract includes the holiday home with inventory and waste collection.

Energy consumption is settled upon departure.

The holiday home may only be occupied by the maximum number of persons specified in the rental contract. Pets may only be brought if agreed upon.

The specified beds and dimensions on the house floor plan are only indicative values. Standard dimensions for double beds vary in width between 140 and 180 cm and in length between 180 and 200 cm. A double bed may consist of either two separate mattresses or one large mattress. Standard dimensions for a single bed are a width of 70 to 90 cm and a length of 180 to 200 cm.

For liability reasons, you may not transfer the cleaning work to other third parties. Setting up tents and caravans on the property is not permitted. If the before mentioned is not observed, Esmark is entitled to terminate the rental contract immediately and without refund of paid amounts. Furthermore, the tenant is obliged to reimburse Esmark for any losses and extra costs incurred due to non-compliance.

Upon conclusion of the contract, Esmark sends the tenant the rental contract. The processing fee is €36 per rental contract. The agreed rent is to be paid either in full or in two instalments. If in two instalments, then as follows:

  • The 1st instalment is due 4 days after booking and amounts to 35% of the rent plus the processing fee.
  • The 2nd instalment is due no later than 50 days before arrival and amounts to the remaining 65% of the rent plus optional extras.


If the contract is concluded less than 50 days before the start of the rental period, the total amount is payable immediately. Payment deadlines and bank details for the transfer are stated in the rental contract. If payment deadlines are not met, this will be considered a cancellation by the tenant; in this case, Esmark reserves the right to terminate the rental contract without notice according to the cancellation fees stated in the rental conditions.

Rebooking or Transfer of the Rental Contract to Another Tenant

A rebooking or transfer of the rental contract is possible up to 60 days before the start of the rental period upon payment of a rebooking fee of €95. Rebookings of the travel period are only possible within the same calendar year. A later rebooking or transfer is considered a cancellation and the above-mentioned cancellation conditions apply.

Changes to the Rental Contract

An extension of the contract or a change in the number of accompanying persons is possible free of charge. Other optional extras such as final cleaning, bed linen packages, handcarts, etc. can be reordered or cancelled free of charge before arrival.

Cancellation

The tenant may cancel the rental contract at any time in writing, either by email to the email address on the rental contract or by post. The date of cancellation is considered to be the date on which it is received by Esmark. Unless the cancellation is due to circumstances covered by Esmark’s extended right of withdrawal, the following cancellation fees apply:

  • Cancellation up to and including 75 days before arrival: 25% of the rent, but at least €105
  • Cancellation 60–74 days before arrival: 50% of the rent
  • Cancellation 30–59 days before arrival: 75% of the rent
  • Cancellation 15–29 days before arrival: 90% of the rent
  • Cancellation less than 15 days before arrival: 100% of the rent

Processing fees and any rebooking fees are non-refundable. Amounts for optional extras such as final cleaning, bed linen, handcarts, etc. will be refunded. For contracts resulting from a rebooking, the cancellation fee is calculated based on the higher amount.

Extended Right of Withdrawal Before Arrival

The rental contract can be withdrawn from without cancellation fee if the tenant’s stay at the rented holiday home becomes impossible or significantly more difficult:

  • Due to the death of accompanying persons at the time of contract conclusion or their spouses, children, parents, siblings, grandparents, grandchildren, in-laws, or due to acute illness or severe injury requiring hospitalisation, doctor-ordered bed rest or equivalent.
  • Acute illness means a newly occurring illness, a justified suspicion of a newly occurring serious illness, or an unexpected deterioration of an existing or chronic illness.
  • If within 2 weeks before the arrival date, significant damage has occurred due to fire or burglary in the tenant’s private home/apartment or due to fire, burglary or contract-violating work interruption in the tenant’s own business.
  • As a result of involuntary unemployment after contract conclusion.
  • Because the tenant was newly employed and therefore unable to take vacation at the booked time.
  • As a result of pregnancy of a fellow traveller after contract conclusion.

Requirements for free cancellation by the tenant:

The tenant must notify Esmark in writing within 24 hours of the occurrence of the reason and before the arrival time specified in the rental contract.
Esmark must receive proof of the cancellation reason within 3 days (72 hours) of notification, e.g. a medical certificate, death certificate, police report, dismissal confirmation or new employment contract. The tenant bears the cost of proof.
If the tenant cancels the rental contract in accordance with the above conditions, the full rental amount will be refunded, minus the processing fee.

Other costs arising in connection with the cancellation are irrelevant to Esmark. Tenants are advised to consult their insurance provider. For questions regarding cancellation, please contact Esmark.

The tenant's right to cancel the rental contract (without cancellation fee) does not apply:

  • If fellow travellers wish to make use of the stay.
  • If the reason for cancellation was known or foreseeable at the time of booking.
  • If compensation can be obtained from another party under travel terms, legal regulations, conventions or travel guarantees.
  • If compensation for rental costs has been paid by insurance.
  • If the reason is an existing illness for which symptoms occurred and/or treatment began within two months prior to contract conclusion.
  • If a doctor advised the tenant or fellow travellers against travelling at the time of booking.
  • If the cancellation is due to the tenant or fellow travellers not fulfilling requirements such as passports, visas, vaccinations, etc.
  • If the cancellation is due to a pandemic.

Extended Right of Withdrawal During the Stay

The rental contract may be cancelled with the right to a partial refund of the rent (except the processing fee) if the tenant terminates the stay at the rented holiday home immediately after arrival and before the departure date:

  • Due to the death of a fellow traveller or their spouse, children, parents, siblings, grandparents, grandchildren, in-laws at contract conclusion, or due to acute illness or serious injury requiring hospitalisation, bed rest, or a doctor’s visit.
  • Acute illness means a newly occurring illness, justified suspicion of a newly occurring serious illness, or an unexpected deterioration of an existing or chronic illness.
  • Because significant damage occurred during the stay due to fire or burglary in the tenant’s private home/apartment or fire, burglary, or non-contractual work interruption in the tenant’s own business.

Requirements for immediate cancellation during the stay

  • The tenant must notify Esmark in writing within 24 hours of the reason.
  • Esmark must receive proof of the cancellation reason within 3 days (72 hours) of notification. E.g. medical certificate, death certificate, police report, dismissal confirmation, or new employment contract. Proof costs are borne by the tenant.

In such cases, the tenant is entitled to a proportional refund of the rent for the remaining full days, up to the total rental price excluding processing fees. Refund is based on the number of full days from the cancellation date until the departure day. If cancellation occurs after 10:00 a.m., the refund starts from the following day. The right to refund requires that the tenant and all travellers vacate the holiday home.

Other costs related to the cancellation are irrelevant to Esmark. Tenants are advised to contact their insurer. For questions regarding cancellation during the stay, Esmark is the contact.

The tenant’s right to cancel the rental contract during the stay without cancellation fee does not apply:

  • If the tenant resumes the stay.
  • If the reason for the interruption existed or was foreseeable before the stay.
  • If fellow travellers continue the stay.
  • If the stay is interrupted due to a pandemic.

Free Holiday Home Insurance in Cooperation with Max Levig/Tryg

The holiday home insurance included in Esmark Travel Security (formerly Esmark Advantage Package*) covers the tenant’s liability under the rental agreement for damages to the furnishings of the rented holiday home during the rental period, including damage to windows, sinks, and kitchen countertops, up to a maximum value of DKK 8,000.

The holiday home insurance does not cover:

  • Normal signs of wear, scratches, marks, soiling, or abrasion.
  • Theft by the tenant, accompanying persons, or guests of the tenant.
  • Liability for intentionally caused damages.
  • Liability for damages caused by the tenant while under the self-inflicted influence of alcohol, drugs, or intoxicants, if the intoxicated state significantly contributed to the occurrence of the damage.
  • Damage caused by dogs or other pets.
  • Damage to bicycles and watercraft, including surfboards, rowboats, canoes, and kayaks, as well as their parts.
  • Damage caused by the use of all types of motor vehicles, including cars, caravans, trailers, or aircraft.
  • Cosmetic damage to sinks, including bathtubs and whirlpool facilities.
  • Damage to saunas and infrared saunas.
  • Damage to swimming pools, whirlpools, hot tubs and the water therein.
  • Fire damage to kitchen countertops.
  • Furnishings brought by the tenant.

The holiday home insurance covers up to DKK 75,000 for damage to the furnishings that occurred during the rental period.

Compensation for completely damaged household items is calculated as follows:

Items less than 2 years old and otherwise undamaged at the time of damage will be replaced based on the purchase price of a comparable new item. For items older than 2 years, compensation is calculated based on the replacement cost of similar new items minus 10% per started year, beginning with the purchase date. The minimum compensation for such items is 20% of the new value.
Esmark may choose to have damaged items repaired or to pay out the depreciated value.
Esmark is entitled, but not obligated, to compensate damages in kind.
Recognition of Claims

Max Levig/Tryg is only obliged to cover costs for damages that have been approved by Max Levig/Tryg. Acknowledgement or payment of a damage by the tenant does not obligate Max Levig/Tryg to cover the incurred costs. By prematurely acknowledging liability, the tenant risks bearing the costs themselves.

Conditions in Case of Damage

In the event of damage, the tenant must inform Esmark immediately and provide the necessary documentation. In the event of damage to the inventory, the tenant must acknowledge the specific damage.

Double Insurance

The insurance does not cover costs that are already covered by another insurance.

Recourse

If damage is covered by property insurance, the liability coverage of the person who caused the damage ceases in accordance with liability law and thus the liability insurance protection, unless the damage was caused intentionally or by gross negligence.

Complaints

If the tenant is dissatisfied with the service or decision received, they may contact the person handling the case. If the tenant is dissatisfied with the service from Max Levig/Tryg or the handling of the complaint, they may submit a written complaint to the following address:

If the tenant is dissatisfied with the handling of the complaint by Max Levig/Tryg, they may contact the following authority outside of Max Levig/Tryg:

The complaint must be submitted using a special complaint form available from the Insurance Complaints Board. A fee must be paid when submitting the form.

Even if a case has been reviewed by the Insurance Complaints Board, the tenant may still take the matter to court. Legal costs may be covered through legal aid insurance or public legal aid depending on the complainant’s income.

100% Price Guarantee

Esmark’s 100% price guarantee applies if the booked holiday home can be booked for the same period and under the same conditions at a lower price in the same currency via another online portal. If this is the case, the tenant will be reimbursed for the price difference.

The 100% price guarantee does not apply if the price difference is due to tax increases or currency/price fluctuations.


Tenant’s Liability

The tenant is obliged to treat the holiday home with care and to leave the house tidy and cleaned upon departure. If pets are brought along, the tenant must remove pet hair before departure – even if final cleaning has been ordered or is included in the rent.

If damage occurs during the rental period, the tenant is obliged to inform Esmark immediately and without delay.

The owner of the holiday home and Esmark are not liable for the tenant or their property. The tenant is therefore responsible for their own insurance during the stay.


Forgotten Items

Forgotten items found in the house are kept for up to two weeks. If no one contacts Esmark within that time, the items are disposed of or donated to a charitable organization. A fee of €30 will be charged for search, handling, and postage to return the forgotten item. Esmark accepts no liability for the return of forgotten items.


Utility Costs

Utility costs for electricity, district heating, solar systems, oil, water, or similar are, unless otherwise stated, not included in the rent. These costs and any outstanding amounts must be paid upon return of the keys.


Deposit

Esmark generally does not charge a deposit. However, Esmark reserves the right to do so in special cases, including:

Youth groups under 25 years: €700.00 per person
If the property owner requires a deposit
If Esmark deems it necessary
Deposits are refunded no later than 14 days after departure, provided the house was left in proper condition, utility costs were paid, and there are no other claims from Esmark. Utility costs cannot be offset against the deposit and must be paid separately.


Complaints

If complaints arise regarding the holiday home, these must be reported to Esmark immediately and without delay. Esmark is entitled, on behalf of the property owner, to remedy the defect as soon as possible. If a justified and timely complaint cannot be resolved by Esmark within 24 hours, the tenant is entitled to a price reduction, calculated according to standard rates of the Danish holiday home association.

If a service staff visit is required, pets may not be left alone in the holiday home, as in such cases the service staff will not enter the house.

Complaints about the cleanliness of the holiday home must be made to Esmark immediately upon arrival and before moving in. Esmark will then inspect the house and possibly arrange additional cleaning.

If arriving outside office hours, the tenant waives the right to complain about cleanliness. Complaints upon or after departure will not be accepted.

If no solution to a complaint can be found, the tenant may file a complaint with the Appeals Board for Holiday Home Rentals (Ankenævnet for Feriehusudlejning) or the EU Online Dispute Resolution platform.


Taxes and Charges

Esmark may increase the rent proportionally in connection with increases in taxes and charges upon presentation of documentation.


Force Majeure and Extraordinary Events

If the holiday home cannot be made available without significant cost or difficulty due to force majeure unforeseen by Esmark at the time of contract conclusion—such as, but not limited to, war, strike, natural disasters, pandemic, epidemic, pollution, or public restrictions—Esmark is entitled to cancel the rental agreement immediately on behalf of itself and the property owner.

In such cases, the tenant is not entitled to compensation, and Esmark is entitled to retain or claim all costs already incurred, such as the processing fee and costs related to the cancellation.


Esmark as Intermediary

Esmark is not the owner of the holiday home but only an intermediary between tenant and owner. Esmark mediates the holiday homes described on the website, and all information is provided to the best of its knowledge.


Other Provisions

Esmark cannot be held liable for noise nuisance from construction, traffic, military exercises, etc.

When renting a holiday home with a swimming pool or standing water whirlpool, the tenant agrees that the service technician may enter the holiday home once a week during normal working hours without prior notice and without the tenant’s presence to ensure hygiene standards and water quality.


Disputes

In case of any disputes concerning the rental agreement, only Danish law shall apply. Jurisdiction is Herning.
